HDM Laminate Limited Residential Warranty
HDM Holz-Dammers GmbH (hereinafter "HDM") provides a 15-year Limited Residential Warranty for ELESGO® Super Gloss Floor to the original purchaser of the aforementioned products. This Warranty shall only be applicable to those products which have been properly installed in approved product applications as recommended by HDM. Improper installation or use in an application contrary to HDM recommendations shall in all instances invalidate this Warranty.
The Limited Residential Warranty shall be valid for a period of 15 years from the date of purchase, and shall cover visible deterioration and the fading of the decorative pattern on the surface of the ELESGO® Flooring, mentioned above, under normal, residential use. During the coverage period areas experiencing such fading or deterioration shall, at HDM's sole option, be either repaired or replaced. This Warranty applies only to areas that are normally visible and are of a size greater than one square inch. This Warranty does not include costs of fitting or finishing the replaced flooring.

PURCHASER ACKNOWLEDGES AND UNDERSTANDS THAT THE WARRANTY SET FORTH HEREIN IS IN LIEU OF ALL OTHER WARRANTIES, EXPRESSED OR IMPLIED, ARISING OUT OR IN CONNECTION WITH THE PRODUCT OF THE USE OR THE PERFORMANCE THEREOF, INCLUDING, BUT NOT LIMITED TO, THE IMPLIED WARRANTIES OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE: THIS WARRANTY IS THE SOLE WARRANTY, AND THEREFORE THE SOLE REMEDY, EXTENDED BY HDM IN REGARD TO THE ABOVE-MENTIONED PRODUCTS.

Each of the following conditions must be met in order for this Warranty to be valid:

1. The Warranty application from on the label must be returned to the Authorized Dealer within one
(1) month of the date of purchase;
2. The original purchaser must notify the Authorized Dealer from whom the flooring was purchased
of any perceived defect, deterioration or fading no later than thirty (30) days after the discovery of
such but within the coverage period of this Warranty; and
3. A valid proof of purchase in the form of a sales receipt must be provided to the Authorized Dealer.
This Limited Residential Warranty is extended only to the original purchaser of the flooring mentioned above an may not be transferred or assigned to any other person, including any subsequent purchaser of the residence in which the flooring is installed.

This Warranty shall not apply to damage arising from the following:
• Accidental damage or abuse or misuse;
• Exposure to extreme heat;
• Scratches, impact or cutting damage;
• Improper installation;
• Improper care and maintenance;
• Modification, alteration, repairs or service by purchaser, by a floor covering dealer not authorized
by HDM, or by any other third party;
• Water damage,
• Damages resulting from or in connection with the sun-floor; or
• Any other damages caused by the purchaser or other third parties.

HDM HOLZ-DAMMERS GMBH DOES NOT GRANT TO ANY PERSON OR ENTITY THE AUTHORITY TO CREATE FOR IT ANY OBLIGATION OR LIABILITY IN CONNECTION WITH THE ABOVE-MENTIONED PRODUCTS. HDM SHALL NOT BE LIABLE TO THE PURCHASER OR ANY OTHER PERSON FOR ANY INCIDENTAL, SPECIAL, OR CONSEQUENTIAL DAMAGES ARISING FROM THIS LIMITED RESIDENTIAL WARRANTY OR ANY OTHER EXPRESS OR IMPLIED WARRANTY.
